Last Will and Testament of Michael Cossel

 24th day of January A. D. 1845

 

In the Name of God Amen

I, Michael Cossel Sen., of the County of Coles and State of Illinois, being weak in body but of sound mind and memory do make, ordain and establish this to be my last will and testament, hereby I do hereby appoint Nathan Ellington to be the executor of this my last will and testament, 

First it is my will, that all my just debts be paid. 2nd, After the payment of all my just debts and funeral expenses, I do hereby give and bequeath to my wife Mary Cossel, one horse, saddle and bridle, three milk cows, (for) her (to) which milk & house hold and kitchen furniture sufficient for her self and family.  Four head of sheep six head stock hogs, and corn wheat & hay sufficient for her self & family, and stock for one year, and all of my Real Estate during her said natural life or widdow hood, on condition that she shall keep the houses fences and farm in good condition, and not commit or suffer committed any useless waste of timber, and fifty Dollars in cash if there should be that much left after paying all my just debts and funeral expenses as aforesaid, all the remainder of my personal property to be sold, by my said Executor and the proceeds thereof to be divided as follows, among my Children & Grandchildren, to Wit John Cossell, Michael Cossel Jun., Katharin Hobbs , Margaret Linder, Solomon Cossel,  Nancy Martin, Elizabeth Linder, William Cossel, Isaac Cossel, and Mary Magdaline Cossel, daugher of Jonathan Cossel decease each to have one full shar and Melinda Duty, and her Eldest son Charles Carmichael, to have one shar, to be equally divided, and the trust? coming to the said Charles Carmichael

in the hands his x mark (&) Mary Magdeline Cossel to be let out at interest by my said Executor until they arrive at lawful age or marry, at which time their respective portions to be paid to them — and at the death or marriage of my wife I will that all my real Estate be sold by my said Executor to the highest bidder on such credit as he may think best, and the proceeds thereof to be divided among my children and grand children as above directed in regard to the proceeds of my personal property.

In testimony whereof I have here unto set my hand and affixed my seal this 24th day of January A. D. 1845

 I do solmnly sware that this writing contains the true last will and testament of the within name Micheal Cossel Dead so far as I know or Heare?? and that I will well and truly execute the same by paying first the debts and then the legacis mentioned therein as far as his goods and chattles will there unto extend and the law charge me and that I will make a true and perfect inventory of all such goods and chattles rights and creadets as may come to my hands as knowledg belonging to the Estate of the Said Deceased and under a fair and just account of my Executorship when there unto required by Law to the best of my knowledeg and ability so help me God.

I do herby certify that Nathan Ellington personaly appeared befor me this 15th Sept. AD 1847 and took the Oath of Office as Executor of the Last Will and testament of Micheal Cossel Dead. in testamoney where of I have here unto set my hand and affixed the Seal of said Court this 15th Day of September AD 1847
